5. NEVER advise anyone to stop making mortgage payments. Suggest that the homeowner consult with an attorney or financial adviser to determine what is in their best interests.
6. Never suggest any solution other than legal means to solve a problem. When in doubt, refer to a core leadership member for advice.
7. Before entering into self-representation (Pro se) fully research the pros and cons on the foreclosure defense websites and requirements for successful litigation. Consider hiring a competent foreclosure defense attorney. Do your own due diligence to find an ethical good, respected attorney who will represent your best interests with competence, diligence and care. Beware of law firms who accept money for loan modifications as state regulators are alert to loan modification scams.
9. Pay it forward. Volunteer outreach and research time as a member of our group. As volunteers we never charge dues/fees for our help.
10. If you cannot afford legal representation, consider pro bono help through your State Bar, or local legal aid offices. Consider volunteering at an attorney's office to do filing, intake, or even scrubbing toilets -- whatever it takes to get legal help. Be strong. Be brave. Be active in saving your homes.
11. Reach out to those who may be losing their way or their homes. So often a few kind words can turn things around. Things may look differently tomorrow as daily we see positive changes taking place.
12. Do not interfere in the legal rights of others. What is right for you may not be right for another. Be protective and supportive of those who come forward to assist us. Sometimes silence is truly golden.
ATTORNEYS
Members have compiled a list of foreclosure defense attorneys that upon request we will provide to you; these attorneys have been recommended by others in the legal industry. ALWAYS do your own due diligence before hiring any attorney or adviser to represent you.
Discovery for fraudulent, unfair or deceptive lending, underwriting, appraisal, escrow and notary practices can take up to one or two years. Some attorneys require on average twenty hours per week of legal work from the beginning to end of pretrial discovery. During this time, was a fair settlement offered to avoid litigation? What constitutes a fair settlement Does it consist of a principal reduction or a temporary modification leading potentially to another foreclosure?QUESTIONS TO CONSIDER WHEN HIRING AN ATTORNEY:
Does the attorney have specialized foreclosure defense trainingthrough a State Bar?
Is the attorney a believer in the truth about Wall Street athat led to the mortgage crises?
Is the attorney honest, ethical, moral, forthcoming, and hard-working?
Is the attorney willing to offer a reasonable payment plan for legal fees and services consisting of a small down-payment and small monthly payments of not more $4000 to $6000 which could vary by state to state, to include a forensic loan audit both through the scope of discovery?
Is it cheaper to litigate than to rent?
The banks and their representatives will try to expose any weakness, real or imaginary. Do your due diligence. Exercise caution. Be smart, be strong. Be diligent. Never give up or give in.
